Join us to hear from the newly appointed President of the State Administrative Tribunal, The Hon Justice Janine Pritchard, and two SAT members on important matters being heard at the Tribunal including building and strata title disputes, the scope of HR in SAT and the demands on the GAA jurisdiction and mediation.

The Civil and Commercial jurisdiction of the Tribunal is varied and complex and accounts for approximately 40% of lodgement of applications received by the Tribunal. Senior Member Wallace will explain the main areas of this jurisdiction, the current developments and the processes utilised to manage the unique aspects of the jurisdiction. In particular the following will be explored:

  • Commercial and Civil jurisdiction – what is it?
  • An overview of the Building Disputes and Strata Titles areas
  • What can you expect at the Tribunal that may be different to the Courts?
    • Specialist members
    • Concurrent evidence or ‘hot-tubbing’
    • Chaired conferral
    • Mediation by decision-makers (mediation ‘with muscle’)
  • What you need to know when appearing at the Tribunal

The HR stream comprises a substantial portion of the work of the Tribunal and all jurisdictions dealing with important personal rights.

Member Hannah Leslie will speak about the work of the stream, with a focus on GAA matters, and will address some current issues.

Some matters considered will be

  • The scope of HR in SAT and the demands on the GAA jurisdiction;
  • The hybrid nature of GAA hearings – the  S  case (2012) Supreme Court decision – expectations of parties (and their lawyers);
  • Practical constraints, natural justice and the approach of members;
  • Best interests and anti-therapeutic processes;
  • What to expect and when to ask for a modified listing.

Time permitting, Member Leslie will also speak about mediations in SAT matters.
