This presentation will cover recent case law and practical issues relating to enduring powers of attorney.
It will examine the nature of the relationship between principal and attorney, the statutory and fiduciary duties of the attorney, what remedies are available in the case of breach of duty and answer some common questions about the extent of the power of an attorney, including whether or in what circumstances an attorney might make a binding death benefit nomination on behalf of the principal.
The presentation will also cover the application of the rule of ademption in circumstances where an attorney sells property the subject of a specific gift under the Will of the principal. Finally, it will look at what makes enduring powers of attorney vulnerable to abuse and compare the Law Council of Australia’s model provision for an enduring power of attorney against Western Australia’s own standard form.
