A lawyer’s duty in relation to conflicts of interest has, as its foundation, the long established fiduciary relationship between lawyers and their clients. When a conflict of interest arises, the lawyer’s duty is to act in “perfect good faith”. This duty is mirrored in the Legal Profession Conduct Rules.

Learn through practical examples of conflicts of interest when instructions should be declined on the basis of a conflict of interest, what information should be disclosed when conflicts arise, and what is required in order to establish effective ‘information barriers’.
