A lawyer’s duty in relation to conflicts of interest has, as its foundation, the long established fiduciary relationship between lawyers and their clients. When a conflict of interest arises, the lawyer’s duty is to act in “perfect good faith”. This duty is mirrored in the Legal Profession Conduct Rules.
