This seminar addresses claims for criminal injuries compensation arising from offences under the Child Welfare Act 1947 and/or the Children and Community Services Act 2004. The Assessors will provide commentary on various sections of the Criminal Injuries Compensation Act 2003 with an emphasis on their application to claims arising from child neglect. These include section 9 (extension of time); section 17 (alleged offences); and sections 31 to 34 (application of jurisdictional maximums). In addition, the application of  X v McAllister [2021] WASC 3 to child neglect will be discussed. Practical suggestions in relation to the compiling of an application will be made, addressing categorisation of offences and the evidence to submit in support of a claim.
