In this Criminal Law Masterclass, leading experts in the legal profession will look at some key topics arising in 2019.

Section 501 of the Migration Act – cancellation issues

Aimed at assisting criminal lawyers in their practice, learn how criminal conduct, charges, convictions or sentences may affect your client’s rights to reside in Australia. This topic will provide an overview of the character cancellation provisions (s501 of the Migration Act 1958), including discretionary and mandatory cancellation as well as current trends and issues.

Sentencing Principles and Fetal Alcohol Spectrum Disorder (FASD)

Fetal Alcohol Spectrum Disorder (FASD) is a condition caused by prenatal alcohol exposure (PAE).   It has been estimated that people diagnosed with FASD are 19 times more likely to be incarcerated at some stage in their life.

There is increasing concern within Australia about the forensic implications of FASD, given the neuropsychological impact can potentially affect all aspects of the court process, such as capacity to stand trial or fitness to plead.

Topics covered in this seminar include:

  • looking at the core neuropsychological features of this cohort
  • discussing the forensic implications for offending and sentencing
  • exploring three important FASD Appeal decisions

Intimate Images Legislation

The introduction of Intimate Image Abuse legislation was an election commitment of the McGowan Government. In 2018 the office of the Commissioner for Victims of Crime worked with the Attorney General to introduce the legislation around Intimate Image Abuse.

The Commissioner will discuss:

  • the national framework for Intimate Image Abuse
  • the current research in regards to the extent, prevalence and impact of Intimate Image Abuse
  • the role of the E-safety Commissioner
  • limitations of the legislation.
