Our lives are increasingly and invariably more and more online. Access to digital assets and records on death or incapacity is an extremely vexed issue for executors, administrators and succession lawyers with few fixed rules in place.

The recent NSW Law Reform Commission Paper on access to digital assets and records has recommended that there be a statutory scheme enacted to allow people to deal with a deceased or incapacitated person’s digital assets.

How far should it go? Will it apply to WA? What is the future of digital access in succession law? What can we learn from NSW and can we apply it to our day to day estate planning or succession practice?

Morgan Solomon

Founding Director at Perth law firm Solomon Hollett Lawyers, Morgan Solomon is a nationally recognised and awarded lawyer who specialises in all forms of succession law. As one of the state's leading legal practitioners in his field Morgan is recognised by Doyles Guide as a pre-eminent Wills and Estates Succession Planning lawyer and as a leading Wills and Estates Litigation lawyer. He is a member of Society of Trust and Estate Practitioners (STEP). He regularly speaks to industry and media about succession issues within the law, legal trends and the impact on Australians and Australian business. A third generation West Australian lawyer, Morgan also takes an active role in the State's cultural community having obtained an honours degree in fine art before his studies in law. Morgan is also a Founding Member of the WA Chamber of Culture and the Arts, sits on the Board of the Prostate Cancer Foundation and is the Chair of the Perth Theatre Trust.
