The importance of drafting a will to accurately reflect the wishes of your client is paramount.  By completing the process thoroughly and accurately at the drafting stage you can pre-empt a number of issues which could arise when the will is called upon, including claims against the deceased estate.

Topics covered will include:

  • The importance of the retainer or letter setting out the scope of the instructions.
  • Back to basics … things which get forgotten when the complexities overwhelm you.
  • Drafting wills containing gifts of real property.
  • And most important, finishing the matter … reporting and file retention.

Susan Fielding

Susan Fielding TEP is formely a Senior Consultant at Jackson McDonald Lawyers, Perth, Western Australia. She is a highly experienced lawyer in the area of succession planning, wills and probate, trusts, administration of deceased estates, estate litigation and guardianship. Susan is a regular speaker on a wide range of matters including probate, trusts, wills and powers of attorney both locally and at national and international conferences. She is a member of the Working Group set up by the Western Australian Attorney General to review the succession laws in Western Australia and is the past chair of the Western Australian branch of STEP (Society of Trust and Estate Practitioners). She is also a member of the Elder Law and Succession Committee of the Law Society of Western Australia and is a representative of the National Elder Law & Succession Committee. Since 2010 she has edited the Western Australian Practice Papers on will drafting, probate and administration of estates for the College of Law. She also edits the chapter on Will Drafting in the Lawyers Practice Manual for SCALES Community Legal Clinic. She is a Life Member of the Law Society of Western Australia.
