Briefing expert witnesses and procuring expert reports is an essential skill in trial preparation for all lawyers whether they act as counsel or instructing solicitor but it can also be both a technical and ethical minefield.

Our experienced panel chaired by His Hon Judge Michael Gething will discuss practical (and potentially career saving) tips in relation to understanding and executing your obligations concerning expert witnesses and the use of expert reports in civil litigation.

The panel will discuss practitioners’ ethical obligations when procuring expert evidence and consider to what extent the multiple Victorian Supreme Court decisions in Hudspeth v Scholastic Cleaning and Consultancy Services Pty Ltd & Ors has application in Western Australia and highlight ‘what to do’ and ‘what not to do’ from a barrister, solicitor and expert’s perspective.

This seminar will also provide practical tips on proofing experts, amending reports ethically and cross examination on experts.
