Hayley Cormann– Engaging experts – A variety of important issues are raised for litigators when identifying, engaging and briefing expert witnesses.  This discussion aims to arm practitioners with an improved methodology and strategies for your practices in securing and briefing experts witness, so that practitioners ultimately can elicit admissible and valuable expert evidence relevant to their client’s case and its outcomes.

Meriel Steadman – Top tips to maximise your success in a dispute – Disputes can be hard to avoid.  In this session you will be given practical tips on what you can do before and during a dispute to put you in the best position for success, together with what to do after a dispute is resolved to set yourself up for success in any future dispute.

Paul Mendelow – Recent Case Law Developments in relation to Waiver of Legal Professional Privilege – One of the biggest areas of controversy in practise is to identify the circumstances in which privilege has been waived or may be waived.

This session will review the various types of privilege that exist and the latest developments relating to waiver of privilege including:

  • When does waiver of privilege occur through matters pleaded?
  • What are your professional obligations when your opponent appears to have inadvertently made available to you a document which on its face attracts privilege?
  • Is privilege waived when instructing experts?
  • Do draft expert reports attract legal professional privilege?
  • How best you can protect your client against inadvertent waiver of privilege.
