This interactive workshop presented by leading Costs experts, Clare Thompson SC and Craig McKie, will discuss non-contentious cost determinations.

The Legal Costs Committee is obliged by the Uniform Law to do a review of its 3 non-contentious determinations. The Committee aims to finalise this by June 2023 and provide updated Determinations which meet the needs of the profession and their clients.

The 3 determinations being reviewed are:

  • Legal Profession (Public Notaries) Determination 2021; 
  • Legal Profession (Non-Contentious Probate Costs) Determination 2021; and
  • Legal Profession (Solicitors Costs) Determination 2021, which covers all non-contentious work (i.e. non-litigation) done by lawyers in WA.

The LCC wants to hear the views of and and get input from lawyers who practise in the areas of work covered by them about making these Determinations better fit the modern practice of law.

Some of the things we will cover include:

  • Are the areas they cover relevant to how you practise law?
  • Are they readily understandable?
  • Is all non-litigious work properly covered?
  • Is the structure of the Determinations readily understandable?
  • What changes would you make to ensure the Determinations remain useful and workable?

We particularly want to hear from lawyers who draft legal documents like leases, contracts, wills, binding financial agreements, trust deeds and similar documents or who make applications for probate and act as executors of deceased estates and family lawyers who to advisory work.
