Pre-action and non-party discovery applications are under-utilised tools in the litigator’s potential repertoire.

Both Clare Thompson and Elspeth Hensler will look into the principles and practice relating to applications for non-party discovery and pre-action discovery both to identify the correct party and to help make a decision as to whether to commence substantive proceedings.

The seminar will further discuss:

  • when it would be useful to make these applications
  • what you need to present to the court to be successful in obtaining an order
  • the pro’s and cons of non-party discovery as opposed to a subpoena

This seminar will be presented in an interactive way, using a case study to involve participants, presenters and the chair.
