Join leading Estates and Succession, Lawyer Maree van der Kwast, Director of Dwyer Durack, for an informative presentation on the remedy of estoppel in estate disputes, drawing on recent cases.

The fundamental of succession law is firstly a person’s right to testamentary freedom – that they may leave their estate to who they wish and  secondly, the primacy of the written word.  However, in recent times, equity  has been eroding this substratum so that its doctrines – and in particular estoppel.  When these two doctrines unite,  there is a real possibility that a person will be constrained as to what they can do with their property and also that their spoken word – or indeed, their actions – will be more important than what was written in the Will.

This talk will examine how estoppel and succession law effect each other.  It will examine the legal principles, recent cases and practical issues that may arise.
