Time Periods Every Property Lawyer Needs to Know and the Consequences of Missing the Time Periods – Simon Moen, Partner, Jackson McDonald

Knowing the raft of time periods that regulate commercial property transactions and what needs to be done is a critical risk management tool for your practice and an essential part of effective legal due diligence. This session, which will include a paper on the subject, will both identify a number of the statutory time frames and explore the consequences of missing those time frames, including:

  • s 10 of the Commercial Tenancy (Retail Shops) Agreements Act 1985 (WA) and consent to sublease and assign;
  • s 68 of the Contaminated Sites Act 2003 (WA) and disclosure of contamination;
  • s 23 of the Duties Act 2008 (WA) and the time to lodge with the Office of State Revenue;
  • the Foreign Acquisitions and Takeovers Act 1975 (Cth) and the time for foreign persons to obtain FIRB approval;
  • s 18 of the Land Administration Act 1997 (WA) and interests in crown land;
  • s 75 of the Land Administration Act 1997 (WA) and conditional tenure land;
  • ss 136 and 140 of the Planning and Development Act 2005 (WA) and sale contracts and long term leases;
  • s 83C of the Property Law Act 1969 (WA) and options to lease for a further term;
  • ss 13B, 13G, 13H and 13I of the Sale of Land Act 1970 (WA) and future lot contracts;
  • s 48 of the Strata Titles Act 1985 (WA) and amendments to by-laws;
  • ss 157 and 160 of the Strata Titles Act 1985 (WA) and notifiable variations;
  • s 163 of the Strata Titles Act 1985 (WA) and the time to register a strata titles scheme; and
  • s 68 of the Transfer of Land Act 1893 (WA) and leases in excess of 5 years.

Nearly 3 years after the reforms to the Strata Titles Act commenced, can we judge whether those reforms have been a success?  This seminar will analyse the amendments made to the Strata Titles Act and what has been learnt from leading strata cases since 1 May 2020 to help answer this question.  This seminar will give attendees an insight into what further reforms may be needed, and into how the State Administrative Tribunal and the Courts deal with strata cases.

 

Transfer Duty Issues Every Property Lawyer Needs to Know (Contracts, Options, Leases, Easements, Nominations, Valuations and More) – David Murphy, Partner, Jackson McDonald

David Murphy’s presentation will cover the duty consequences arising from entering into common property related transactions including land sales, put and call options, leases, easements and assignments and nominations of property related interests. It will also cover issues relating to valuations of real property interests as outlined in the Duties Act.
