Legal practice can be challenging. One of the most important tools a lawyer can possess is how to maintain a calm approach to what can become a heated discussion or situation.

This  seminar chaired by the Honourable Justice Janine Pritchard is open to all practitioners and is focused on communications with fellow lawyers and a reminder of the benefits of collegiality and courtesy in practice by looking at what professional courtesy looks like in a number of scenarios including:

  • negotiations – when it is appropriate (if ever) to capitalise on the other side’s mistakes
  • mediation and settlement – what can properly be considered to be a “without prejudice” communication
  • appropriate tone and approach to take when dealing with self-represented litigants or difficult opposing lawyers
  • when it is appropriate to make a formal complaint against a fellow practitioner
