LAW SOCIETY OFFICES VISITOR PROTOCOL – COVID 19

From Monday 31 January 2022, all visitors to our offices who do not have a medical exemption must be fully vaccinated for COVID-19.

When a person dies, they may have funds held in their members account in a superannuation fund. Two questions arise:

Firstly, who gets the money? and how can the member ensure it goes where they want and not where the trustee may decide?

Secondly, what tax is payable by the recipient? and what steps can the member take to reduce the tax burden on the recipient?

This seminar will concentrate on self-managed superannuation funds and act as a primer for lawyers advising clients on succession planning.

Topics to be covered will include:

• The role of Binding Death Benefit Nominations and what can go wrong with them;
• Who will be the trustee and whether their decisions can be challenged;
• The powers of the executor and the constraints on executors; and
• Pension and recycling strategies.
