This seminar will be presented by Nathan Landis, Barrister at Francis Burt Chambers, and Aaron McDonald, Managing Director at Pragma Lawyers.
The seminar will be covering:
- The advantages and disadvantages of making a strike out application
- How bad should a pleading be before one makes an application
- The steps for doing this (set out in really quite basic detail, so it is useful for people who haven’t done these before), and a sample set of programming orders
- Management of the common situation where the other side (i.e. the bad pleader) negotiates and agrees to remove the worst parts, but won’t agree to remove the borderline parts
- The likely delay for the overall matter
- Any differences between the different courts
- Usual costs for each of the parties
- The range of costs orders which are regularly made – it would be interesting to consider reported decisions regarding strike out applications in the last year
