  • Unless you notify the Society otherwise in writing:
    (a) your new membership status will be listed in the Society's Brief journal; and
    (b) it is assumed that this Society is authorised to disclose the fact of your membership to any reputable organisation which the Society might be associated with if that association results in benefits to the Society
  • (a) my membership is subject to the Constitution of the Law Society (as amended from time to time);
    (b) as a requirement for Ordinary membership, the Constitution of the Law Society requires an Ordinary member to be an Australian Legal Practitioner or a person who is lawfully entitled under the laws of the Commonwealth to practise in Western Australia;
    (c) by:
    (i) s5(a) of the Legal Profession Act 2008 (WA) (Act), an Australian legal practitioner means an Australian lawyer who holds a current local practising certificate or a current interstate practising certificate; and
    (ii) s36(3) of the Act, a WA government lawyer engaged in government work (as those expressions are defined within s36) is taken to be an Australian legal practitioner;
    (d) all Australian legal practitioners practising in Western Australia are governed by the Act (as amended from time to time) and bound by the Legal Profession Conduct Rules 2010 (WA) (as amended from time to time) in addition to any duty or requirement imposed on a practitioner by statute, law or equity; and
    (e) As an Australian Legal Practitioner seeking or renewing membership of the Law Society the Professional Standards Scheme applies to me and in order to notify the Law Society of my participation I am required to submit a Professional Standards Scheme Participation Information form.
    (f) As an Australian Legal Practitioner seeking or renewing membership of the Law Society and exemption from participation in the Professional Standards Scheme I am required to submit an application for exemption from the Scheme, or to be an Australian Legal Practitioner on whose behalf an application for exemption has been made.
  • LAW SOCIETY OF WA (INC) COLLECTION NOTICE: The Society collects the personal information contained in this form pursuant to the provisions of the Privacy Act, 1988 and the Australian Privacy Principles. The information is collected by the Society to enable it to deal with the matters the subject of this form and to provide its services and benefits (and the benefits and services of the Law Council of Australia) to its members and the public.   • Professional Standards Scheme

  • On 1 July 2019 the Law Society launched a Professional Standards Scheme (Scheme) for the benefit of its members.

    Incorporated Legal Practice (ILP) members, Ordinary members and Life members of the Law Society who hold an Australian Practising Certificate are automatically members of the Scheme unless exempted by the Law Society from participation on application by the member. To allow the Law Society to administer the Scheme appropriately, and to calculate the monetary ceiling (maximum amount of liability) which may apply in any given case, the Law Society requires each applicant for Ordinary membership who holds an Australian Practising Certificate, and each applicant for ILP membership, to complete a Professional Standards Scheme Participant Information form.

    Any application for Ordinary membership (by a person who holds an Australian Practising Certificate) or ILP membership must be accompanied by:

    a) a completed “Professional Standards Scheme Participant Information” form OR

    b) in the case of a person seeking exemption, subject to s30(4) of the Professional Standards Act 1997, an Application for Exemption from participation in the Scheme.
