Excerpt: The Construction Contracts Act 2004 (WA) is intended to provide a quick and low cost means of dispute resolution between parties to construction contracts. The object of the adjudication process provided for by the Act is to produce a determination, which can be enforced as a judgement in Court provided that it complies with the Act. Such a determination is interim only and does not decisively deal with the rights of the parties, which can be tested in more conventional dispute resolution procedures (such as arbitration) or in Court as the case may be.
